Fines for Failing to Comply

All information in the Compliance Statement needs to be accurate before the tenancy agreement can be signed. It must be updated throughout the duration of the tenancy when any necessary work related to it is finished.

It’s also important to keep in mind that landlords with multiple rental properties may face greater penalties for non-compliance. The most severe penalties are given for severe violations, and landlords who own more than six properties could be fined as high as $50,000, and as much as $100,000 for hearing claims.

Tenancies signed from 1 July 2019 to 30 , June 20,21

  • Underfloor and ceiling insulation is compulsory in all Whakatu and New Zealand rental houses where it’s reasonably practicable to install.
  • A Healthy Homes Declaration of Intent as well as an Insulation Statement, and an Insurance Statement should be included in any renewal, new or amended tenancy agreement.
  • Property managers and landlords have to keep records that demonstrate compliance with each Healthy Homes Standards that apply or will be applicable during the tenure of their rental properties.

Beginning 1 July 2021

Heating Whakatu

Rental properties in Whakatu must have a fixed source of heating which can warm the principal or the biggest living space to a minimum of 18degC, even during the most coldest days of the year. This is the recommended minimum indoor temperature that is recommended by the World Health Organisation for people’s physical health and mental outlook.

The source of heating requirements to remain fixed (i.e., not portable) with at least 1.5 horsepower in capacity, and it must have the minimum heating capacity needed for the main living room. The Heating Assessment Tool can be used to determine if your current installed heater(s) are sufficient or whether you will require to "top up" by adding a second heater. Open fires as well as unflued combustion heaters like portable LPG bottle heaters are not considered to be safe heating options in the Healthy Homes Standard.

If the heating that you offer is an electric heater or heat pump it should have the thermostat. This will help make the heating more consistent and effective. For most properties, larger fixed heating devices such as wood burners, heat pumps pellet burners, flued gas heaters are necessary. However, in certain instances like small apartment buildings small apartments, a smaller electric fixed heater could be enough.

If your main living space is already equipped with a fixed heating source like a heat pump, then it might just require an upgrade to be able to meet the standards. Ceiling and underfloor insulation has been compulsory to all rental homes since July 1, 2019. Property managers and landlords are required to ensure that the insulation is up to the new standard.
