Fines for Failing to Comply

As of 1st July 2021, when a new or renewed contract is signed on a Hawkes Bay rental property, all Healthy Homes compliance work must be taken care of inside of 90 days.

Since the 1st July of 2021, if a new or renewed contract is signed on a Hawkes Bay rental property, all Healthy Homes compliance work must be taken care of inside of 90 days.

Failure to meet one of the Healthy Homes Standards within the expected timeframe can result in a fine of up to $7200. Furthermore, if a current Healthy Homes Statement of Compliance is not included in a new, renewed or revised tenancy contract, there could be an additional fine or violation fee.

Any tenant may request information about the Healthy Homes Standard and how they are related to the house they are living in. If the landlord or property manager is unable to supply the required information within 21 days of receiving the request, they could be issued an infringement notice and be fined as high as $750.

Furthermore, there’s also a penalty as much as $900 for landlords and property managers providing a false or incorrect Healthy Homes Compliance Statement or other information. The person liable for this fine is the person who is listed on the tenancy agreement as the person who is letting the property out It could also be the name of the landlord or the property management company.

All information in the Statement of Compliance needs to be up-to-date when the tenancy contract is signed. It should be kept updated throughout the duration of the tenancy when any relevant work gets completed.

It is also important to remember that a landlord with multiple rental properties may receive even higher fines for non-compliance. The harshest penalties are given only for serious breaches, and landlords with more than six properties could be fined as high as $50,000 and as high as $100,000 in the case of hearing claims.

Hawkes Bay Healthy Homes Compliance Timeframes

Tenancies established beginning on 1 July 2019 and 30 June 2021

  • Underfloor and ceiling insulation is a requirement in all Hawkes Bay and New Zealand rental homes where it is reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement along with an Insulation Declaration and an Insurance Statement must be included in any new, renewed or altered tenancy contract.
  • Property managers and landlords must keep records that demonstrate the compliance with all Healthy Homes Standards that apply or will be in force to your rental home.

Starting 1 July 2021

  • Property managers and private landlords are required to ensure their rental properties conform in accordance with Healthy Homes Standards within 90 days of any renewal, new or a change in tenant.
  • All boarding households (except Kainga Ora and registered Community Housing Provider for boarding home tenancies) must comply with the Healthy Homes Standard regardless of the date when the tenancy started.

Beginning 1 July 2023

  • All houses rented to Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must meet the Healthy Homes Standards regardless of the date the tenancy was started.

From 1 July 2024

  • All rental houses have to meet the Healthy Homes Standards regardless of the time of the first day of tenancy.
Unreasonable Gaps & Holes

Heating Hawkes Bay

Rental properties in Hawkes Bay need to have a stable source of heat that is able to heat the largest or main living space to a minimum of 18degC even on the coldest days of the year. This is the recommended minimum indoor temperature recommended by the World Health Organisation for people’s physical well-being and mental well-being.

The source of heat needs to remain fixed (i.e. not portable) that is, at minimum 1.5 horsepower in capacity and have the minimum capacity for heating required to heat the living space in general. In most homes, larger fixed heating equipment like heat pumps, wood burners, pellet burners or flued gas heaters will be required. However, in certain instances like apartments with small spaces the smaller fixed electric heater could be enough.

If your main living space already has a fixed heating source like a heat pump, then it may need some additional energy to be able to meet the standards. Certain types of heaters cannot be used to achieve the quality because they’re costly, not affordable to run, or are unsafe to operate.

Ventilation Hawkes Bay
