Fines for Failing to Comply

As of 1st July 2021, if a new or renewed tenancy is signed on a Wairoa rental property, all Healthy Homes compliance items have to be completed within 90 days.

As of 1st July 2021, when a brand new or renewed contract is signed on the Wairoa rental property, all Healthy Homes compliance work must be done by the end of 90 days.

Additionally, there is an additional fine of approximately $900 for landlords and property managers providing a false or misleading Healthy Homes Statement of Compliance or information. The person who is responsible for this fine is whoever is named on the tenancy agreement as the person who is letting the property out, so it could be the name of the landlord or the property management company.

It’s also crucial to note that a landlord with multiple rental properties may face greater penalties for non-compliance. The harshest penalties are handed down for severe breaches, and landlords with six or more properties can be fined up to $50,000, or as high as $100,000 in hearings.

Wairoa Healthy Homes Compliance Timeframes

Tenancies commenced between 1 July 2019 and 30 June 2021

  • The insulation of the ceiling and underfloor is required for all Wairoa and New Zealand rental houses where it is reasonably practicable to install.
  • A Healthy Homes Declaration of Intent along with an Insulation Declaration and an Insurance Statement must be included with any renewed, new or varied tenancy agreement.
  • Property managers and landlords have to keep records to demonstrate the compliance with any Healthy Homes Standard that apply or will be in force during the tenancy of the rental property.

Starting 1 July 2021

  • Property managers and private landlords should make sure that their rental properties are in compliance to the Healthy Homes Standard within 90 days of any new, renewed , or altered tenancy.
  • All boarder homes (except Kainga Ora and Community Housing Providers with registered boarder house tenancies) must comply with the Healthy Homes Standard regardless of the date when the tenancy started.

Beginning 1 July 2023

  • All households rented through Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must be in compliance with the Healthy Homes Standards regardless of when the tenancy began.

From July 1st 2024

  • All rentals houses have to meet the Healthy Homes Standards regardless of when the tenancy began.

Heating Wairoa

Wairoa rental properties require a reliable source of heating that is able to heat the main or largest living space to at least 18degC, even during the winter coldest days. This is the minimum temperature indoors that is recommended by the World Health Organisation for people’s physical health and mental wellbeing.

The source of heating needs to remain fixed (i.e. not portable), at least 1.5 Kilowatts in heating capacity, and meet the minimum requirement for heat capacity for the main living room.
