Fines for Failing to Comply

From the 1st of July in 2021, when a brand new, renewed or varied contract is signed on a Waipawa rental property, all Healthy Homes compliance items need to be taken care of inside of 90 days.

The person who is responsible to pay this fine is the one who is identified on the tenancy agreement as being the person letting the property out and it could be the name of the landlord or the company that manages the property.

All the information on the Compliance Statement needs to be up-to-date when the tenancy agreement is signed. It is updated through the tenancy period as relevant work gets completed.

It’s important to be aware that landlords who own multiple rental properties may receive additional fines for non-compliance. The most severe penalties are handed down for the most serious violations. Those who have more than six properties could be fined up to $50,000, and even as high as $100,000 in the case of hearing claims.

When do I require to meet The Healthy Homes Standards?

Waipawa Healthy Homes Compliance Timeframes

Tenancies commenced between 1 July 2019 and the 30th June in 2021

  • Ceiling and underfloor insulation is a requirement for all Waipawa and New Zealand rental homes where it is reasonably practicable to put in.
  • A Healthy Homes Statement of Intent to Comply An Insulation Statement as well as an Insurance Statement must be included in any new, renewed or modified tenancy agreement.

In some instances, like apartments with small spaces small apartments, a smaller electric fixed heater may suffice.

If your living space already has a fixed heating source like an air conditioner, it could require a top up to be able to meet the standards. Certain types of heaters cannot be utilised to meet the quality because they’re costly, not cost-effective to run, and/or unhealthy to run.
