Fines for Failing to Comply

As of 1st July 2021, when a brand new or renewed contract is signed on a Te Mata rental property, all Healthy Homes compliance tasks have to be finished within 90 days.

Beginning on July 1st, 2021, once a new, renewed or varied lease is entered into on the Te Mata rental property, all Healthy Homes compliance work must be done by the end of 90 days.

Failure to meet any of the Healthy Homes Standards by the end of the expected timeframe can result in an amount of $7200. Furthermore, if a current Healthy Homes Statement of Compliance is not incorporated in a new, renewed or revised tenancy contract, it could result in additional penalties or an infringement fee.

Any tenant may request details regarding the Healthy Homes Standard and how they relate to the home they are living in. If the landlord or the property manager doesn’t provide the necessary information within 21 days of receiving the request, they could receive an infringement letter and be fined up to $750.

In addition, there’s also a penalty of approximately $900 for landlords and property managers who offer a false or false Healthy Homes Compliance Statement or information. The person who is liable to pay this fine is the one who is listed on the tenancy agreement as the person who is letting the property out, so it could be the name of the landlord as well as the company that manages the property.

The information contained in the Statement of Compliance requirements to be correct at the time that the tenancy agreement is signed. It must be updated throughout the tenancy as any associated work has been completed.

It’s important to note that a landlord who own multiple rental properties may face greater penalties for non-compliance. Te Mata Healthy Homes Compliance Timeframes

Tenancies established in the period between July 1st 2019 and 30 June 2021

  • Ceiling and underfloor insulation is compulsory to all Te Mata and New Zealand rental houses where it’s reasonably practicable to put in.
  • A Healthy Homes Statement of Intent to Comply as well as an Insulation Statement, and an Insurance Statement should be included in any renewal, new or amended tenancy agreement.

From July 1st 2024

  • All rental homes must be in compliance with the Healthy Homes Standards regardless of the date when the tenancy started.

Rental properties in Te Mata need to have a stable heating source that can heat the living space to at least 18 degrees Celsius, even on the most coldest days of the year. Ventilation Te Mata

Insulation for underfloor and ceilings has been compulsory for all rent homes as of July 1st, 2019. All landlords and property managers are required to ensure that the insulation is in line with this new standard. In some cases, an existing insulation on the ceiling or in the subfloor space may need to be added or replaced.
