Did you know that the Healthy Homes Standards came into effect on the 1st July 2021? Landlords now have to make sure their Te Hauke rental properties meet the minimum Healthy Homes Standards within 90 days of the start of any new or renewed tenancy, and all private rentals are required to be completely certified by 1 July 2024.

Fines for Failing to Comply

As of 1st July 2021, when a brand new or renewed tenancy is signed for a Te Hauke rental property, all Healthy Homes compliance tasks need to be done by the end of 90 days.

Beginning on July 1st, 2021, once a new or renewed tenancy is signed on the Te Hauke rental property, all Healthy Homes compliance work must be done by the end of 90 days.

Inability to adhere to any of the Healthy Homes Standards by the end of the deadlines can result in the possibility of a fine up to $7200. Additionally, if the most existing Healthy Homes Statement of Compliance isn’t incorporated in an updated, renewed, or revised tenancy agreement there may be an additional penalty or infringement fee.

Every tenant is entitled to request information regarding the Healthy Homes Standard and how they are related to the house they are living in. If the landlord or property manager fails to provide the necessary information within 21 days of having received the inquiry, they can receive an infringement notification and be fined upto $750.

In addition, there is an additional fine of approximately $900 for landlords and property managers that provide false or incorrect Healthy Homes Statement of Compliance or information. The person who is liable for this fine is the person who is identified on the tenancy agreement as being the person letting the property out It could also be the name of the landlord as well as the company that manages the property.

All information in the Compliance Statement needs to be correct at the time that the tenancy agreement is signed, and ideally it should be kept updated through the tenancy period as associated work has been completed.

It is important to remember that a landlord who own several rental properties can face additional fines for non-compliance. The highest penalties are given only for serious violations, and landlords who own at least six rental properties could receive fines of up to $50,000 and as high as $100,000 in hearings.

Te Hauke Healthy Homes Compliance Timeframes

Tenancies commenced from 1 July 2019 and 30 June 2021

  • Insulation of the underfloor and ceiling is a requirement for all Te Hauke and New Zealand rental homes where it is reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement, an Insulation Statement and an Insurance Statement must be included in any new, renewed or amended tenancy agreement.
  • Property managers and landlords must keep records of their the conformance to any Healthy Homes Standard that apply or will be applicable throughout the tenancy period of their rental properties.

Starting 1 July 2021

  • Private landlords and property managers have to make sure their rental properties conform to the Healthy Homes Standards within 90 days of any new, renewed , or altered tenant.
  • All boarder homes (except Kainga Ora and registered Community Housing Provider for boarding house tenancies) must comply with the Healthy Homes Standard regardless of the date the tenancy was started.

Starting 1 July 2023

  • All homes that are rented out by Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers are required to comply with the Healthy Homes Standards regardless of when the tenancy began.

Starting 1 July 2024

  • All rental houses must be in compliance with the Healthy Homes Standard regardless of the time of the first day of tenancy.
Unreasonable Gaps & Holes

Draught Stopping Te Hauke

Draughts are a major cause of lower temperatures in houses. A cold home costs more to heat, which results in wasting energy and incurring higher costs.

If a draught could be felt from unreasonable gaps or holes or holes, it needs to be sealed.

What are unreasonable gaps or holes?

If you can feel external air getting in, or see a clear draught from a hole or gap, then it’s most likely a gap or an opening that needs sealing in some way. Adequate heaters are crucial for well-being houses

Heating Te Hauke

Rental properties in Te Hauke should have a permanent heating source that can heat the living area to at minimum 18degC, even on the coldest winter days. This is the minimum temperature indoors suggested by the World Health Organisation for people’s physical health and mental well-being.

The source of heat needs for it to be permanent (i.e. not portable), at minimum 1.5 Kilowatts in heating capacity, and must meet the minimum required heating capacity in the living area. A Heating Assessment Tool could be used to check if the current installed heater(s) are sufficient or whether you will require to "top-up" with an additional heater. Fires that are open and unflued heaters such as portable LPG bottle heaters aren’t considered to be suitable heating options for The Healthy Homes Standard.

If the heating that you offer is an electric heater or heat source, it must be equipped with an thermostat. This will make the heating more uniform and efficient. For most properties, larger heaters that are fixed, such as wood burners, heat pumps, pellet burners or flued gas heaters will be required. However, in some cases like small apartment buildings the smaller fixed electric heater could be enough.

If the main living room already has a central heating source such as heat pumps, it might need some additional energy to make sure it meets the requirements. Certain kinds of heaters cannot be used to comply with the quality as they are either not effective, cost prohibitive to operate and/or unhealthy to run.

Ventilation Te Hauke

Every living space in a rental home must have at least one opening door or window to offer natural ventilation. Furthermore, moist areas such as kitchens and bathrooms must have a suitable externally vented extractor to get rid of moisture.

Insulation Te Hauke

The insulation of the ceiling and underfloor has been compulsory for all rent houses since 1 July 2019. Property managers and landlords must make sure the insulation meets the new quality. In some instances, current ceiling insulation, or the insulation of the subfloor space may need to be added or replaced.
