All information in the Statement of Compliance needs to be accurate when the tenancy contract is signed. It must be updated through the tenancy period as necessary work related to it is finished.

It is also crucial to note that landlords who manage multiple rental properties may face even higher fines for non-compliance. The highest penalties are handed down for the most serious breaches. Landlords with six or more properties can be fined as high as $50,000 and as high as $100,000 in the case of hearing claims.

Tamatea Healthy Homes Compliance Timeframes

Tenancies established in the period between July 1st 2019 to the 30th June in 2021

  • The insulation of the ceiling and underfloor is compulsory for all Tamatea and New Zealand rental houses where it is reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement, an Insulation Statement and an Insurance Statement must be included in any renewal, new or altered tenancy contract.
  • Property managers and landlords are required to keep records that demonstrate compliance with each Healthy Homes Standard that apply or will be applicable throughout the tenancy period of their rental properties.

From 1 July 2021

  • Property managers and private landlords are required to ensure that their rental properties are in compliance with the Healthy Homes Standards within 90 days of a new, renewed , or altered Tenancy.
  • All boarding homes (except Kainga Ora and registered Community Housing Provider boarder house tenancies) are required to comply with Healthy Homes Standard regardless of the date when the tenancy started.

Beginning 1 July 2023

  • All households which are rented through Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must comply with the Healthy Homes Standards regardless of the date the tenancy was started.

Starting 1 July 2024

  • All rentals homes must be in compliance with the Healthy Homes Standards regardless of the date when the tenancy started.
