Fines for Failing to Comply

As of 1st July 2021, when a new or renewed contract is signed on a Roys Hill rental property, all Healthy Homes compliance items have to be completed inside of 90 days.

It’s crucial to remember that landlords who own multiple rental properties may receive greater penalties for non-compliance. The harshest penalties are given for severe violations. Those who have at least six rental properties could receive fines of up to $50,000, or as high as $100,000 for hearing claims.

When do I need to meet The Healthy Homes Standards?

Roys Hill Healthy Homes Compliance Timeframes

Tenancies signed in the period between July 1st 2019 and the 30th June in 2021

  • Underfloor and ceiling insulation is required throughout Roys Hill and New Zealand rental homes where it is reasonably practicable to put in.
  • A Healthy Homes Statement of Intent to Comply along with an Insulation Declaration and an Insurance Statement must be included in any renewed, new or modified tenancy agreement.
  • Property managers and landlords must keep records that prove the compliance with each Healthy Homes Standard that apply or will be applicable during the tenancy of an apartment rental.

Starting 1 July 2021

  • Private landlords and property managers must make sure their rental properties comply with the Healthy Homes Standards within 90 days of any new, renewed , or altered lease.
  • All boarder homes (except Kainga Ora and Community Housing Providers with registered for boarding home tenancies) must comply with the Healthy Homes Standards regardless of the time the tenancy began.

From 1 July 2023

  • All homes that are rented out from Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must comply with the Healthy Homes Standards regardless of when the tenancy began.

Starting 1 July 2024

  • All rental houses must be in compliance with the Healthy Homes Standard regardless of when the tenancy began.
