Fines for Failing to Comply

From the 1st of July in 2021, if a new or renewed tenancy is signed on a Pukahu rental property, all Healthy Homes compliance tasks must be finished by the end of 90 days.

From the 1st of July in 2021, once a new or renewed Tenancy is signed for a Pukahu rental property, all Healthy Homes compliance work must be completed within 90 days.

Inability to adhere to any of the Healthy Homes Standards by the end of the deadlines can result in penalties of up to $7200. Additionally, if the most existing Healthy Homes Statement of Compliance isn’t included in a new, renewed or revised tenancy contract, there could be additional penalties or an infringement fee.

Any tenant may request information about the Healthy Homes Standard and how they relate to the home they live in. If the property manager is unable to provide the information requested within 21 days from being informed of the request, they may be issued an infringement notice and be fined up to $750.

In addition, there’s an additional fine of approximately $900 for landlords and property managers providing a false or misleading Healthy Homes Compliance Statement or other information. The person responsible for this fine is the person who is listed on the tenancy contract as the person letting the property out and it could be the name of the landlord as well as the property management company.

All information in the Compliance Statement requirements to be correct at the time that the tenancy agreement is signed, and ideally it should be kept updated throughout the duration of the tenancy when any necessary work related to it is finished.

It’s also important to be aware that landlords who manage multiple rental properties may receive even higher fines for non-compliance. The highest penalties are reserved for the most serious violations. Those who have at least six rental properties could receive fines of up to $50,000, and even as high as $100,000 in the case of hearing claims.

Pukahu Healthy Homes Compliance Timeframes

Tenancies commenced beginning on 1 July 2019 and the 30th June in 2021

  • Underfloor and ceiling insulation is mandatory in all Pukahu and New Zealand rental homes where it is reasonably practicable to put in.
  • A Healthy Homes Statement of Intent to Comply An Insulation Statement as well as an Insurance Statement must be included in any new, renewed or modified tenancy agreement.
  • Landlords and property managers must keep records that demonstrate conformance with all Healthy Homes Standard that apply or will be in force throughout the tenancy period of an apartment rental.

Heating Pukahu

Rental properties in Pukahu need to have a stable heating source that can warm the living room to at least 18 degrees Celsius, even on the coldest days of the year. This is the recommended minimum indoor temperature suggested by the World Health Organisation for people’s physical well-being as well as their mental health.

If your main living space already has a central heating source like an air conditioner, it could require an upgrade to meet the standards. Some types of heaters can’t be used to comply with the standard since they’re either costly, not cost-effective to run, or are unsafe to operate.

The insulation of the ceiling and underfloor is a requirement to all rental houses since 1 July 2019. Property managers and landlords are required to ensure that the insulation meets the new standard. In certain situations, the existing ceiling insulation or insulation in the subfloor space may need to be replaced or replaced.
