Fines for Failing to Comply

As of 1st July 2021, once a new or renewed tenancy is signed for a Parkvale rental property, all Healthy Homes compliance work need to be completed within 90 days.

Beginning on July 1st, 2021, if a new, renewed or varied lease is entered into on a Parkvale rental property, all Healthy Homes compliance work must be done within 90 days.

It is crucial to note that a landlord with multiple rental properties may face greater penalties for non-compliance. The harshest penalties are reserved for the most serious violations. Those who have more than six properties could be fined as high as $50,000, or as high as $100,000 in the case of hearing claims.

When will I need to be in compliance with the Healthy Homes Standards?

Parkvale Healthy Homes Compliance Timeframes

Tenancies signed from 1 July 2019 to the 30th June in 2021

  • Ceiling and underfloor insulation is required throughout Parkvale and New Zealand rental houses where it is reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement, an Insulation Statement and an Insurance Statement must be included with any renewed, new or amended tenancy agreement.
  • Property managers and landlords have to keep records that demonstrate compliance with each Healthy Homes Standard that apply or will be applicable to your rental home.

From 1 July 2021

  • Private landlords and property managers must make sure that their rental properties are in compliance according to Healthy Homes Standard within 90 days of any newly renewed, extended or changed lease.
  • All boarding homes (except Kainga Ora and registered Community Housing Provider boarding house tenancies) must comply with the Healthy Homes Standard regardless of the time the tenancy began.

From July 1st 2023

  • All houses that are rented out through Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered are required to comply with the Healthy Homes Standards regardless of the date the tenancy was started.

Beginning 1 July 2024

  • All rentals homes have to meet the Healthy Homes Standards regardless of the time of the first day of tenancy.
