Fines for Failing to Comply

As of 1st July 2021, when a new or renewed contract is signed on a Pakowhai rental property, all Healthy Homes compliance tasks must be completed by the end of 90 days.

Beginning on July 1st, 2021, if a new, renewed or varied lease is entered into on a Pakowhai rental property, all Healthy Homes compliance work must be taken care of within 90 days.

Failure to comply with each of Healthy Homes Standards inside of the expected timeframe can result in an amount of $7200. In addition, if the existing Healthy Homes Statement of Compliance is not incorporated within a new, renewed or revised tenancy agreement, there could be an additional penalty or infringement fee.

It’s also important to be aware that a landlord with multiple rental properties could face more severe penalties for not complying. The harshest penalties are given only for serious breaches, and landlords with six or more properties could be fined up to $50,000, or as high as $100,000 in hearing claims.

Pakowhai Healthy Homes Compliance Timeframes

Tenancies that were signed from 1 July 2019 to 30 June 2021

  • Insulation of the underfloor and ceiling is a requirement in all Pakowhai and New Zealand rental homes where it’s reasonably practicable to put in.
  • A Healthy Homes Intent to Comply Statement An Insulation Statement as well as an Insurance Statement should be included in any renewed, new or modified tenancy agreement.
  • Landlords and property managers must keep records of their conformance with the Healthy Homes Standards that apply or will be applied during the tenure of an apartment rental.

From 1 July 2021

  • Private landlords and property managers are required to make sure that their rental properties are in compliance according to Healthy Homes Standards within 90 days of any new, renewed or varied tenancy.
  • All the boarding households (except Kainga Ora and Community Housing Providers with registered boarder household tenancies) must adhere to the Healthy Homes Standard regardless of when the tenancy began.

From July 1st 2023

  • All homes let to Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers are required to comply with the Healthy Homes Standards regardless of when the tenancy first began.

From July 1st 2024

  • All rental houses are required to comply with Healthy Homes Standards regardless of when the tenancy began.

Draughts are a major cause of low temperatures inside houses. A draughty home costs more to heat, which means wasting energy and resulting in higher bills.

A good heating system is crucial to ensure healthy houses

Heating Pakowhai

Pakowhai rental properties require a reliable source of heat that can heat the main or largest living room to at least 18degC, even on the winter coldest days. This is the minimum temperature indoors recommended by the World Health Organisation for people’s physical health as well as their mental health.

The source of heat requirements to remain fixed (i.e., not portable) that is, at minimum 1.5 horsepower in capacity, and meet the minimum capacity for heating required in the living area. The Heating Assessment Tool can be used to determine if your current fixed heater(s) are adequate or whether you will need to "top up" with an additional heater. Open fires and unflued combustion heaters, such as the portable LPG bottle heaters aren’t considered to be safe heating options for the Healthy Homes Standard.

If the heating system you offer is an electric heater or heat pump, it should be equipped with a thermostat. This will make your heating more consistent and effective. In most houses, larger fixed heating equipment like wood burners, heat pumps, pellet burners or flued gas heaters are needed. In some instances, like small apartments an electric, fixed heater may suffice.

If the living area is already equipped with a fixed heating source, like a heat pump, then it may need some additional energy to be able to meet the standards. Certain types of heaters cannot be used to meet the quality since they’re either expensive, inefficient or unsafe to operate.

Ventilation Pakowhai

The insulation of the ceiling and underfloor is required in all rental homes from 1 July 2019. All landlords and property managers have to make sure that the insulation meets standards that are in line with the latest quality. In some instances, current ceiling insulation, or the insulation of the sub floor space may need to be topped up or replaced.
