Fines for Failing to Comply
Beginning on July 1st, 2021, when a brand new, renewed or varied contract is signed on a Napier South rental property, all Healthy Homes compliance items need to be finished by the end of 90 days.
From the 1st of July in 2021, if a new, renewed or varied contract is signed on a Napier South rental property, all Healthy Homes compliance work must be taken care of by the end of 90 days.
Inability to adhere to any of the Healthy Homes Standards by the end of the expected timeframe can result in the possibility of a fine up to $7200. Furthermore, if a current Healthy Homes Statement of Compliance isn’t included within the renewal, new or revised tenancy agreement, it could result in additional penalties or an infringement fee.
Every tenant is entitled to request information about the Healthy Homes Standard and how they relate to the property they are living in. If the property manager does not provide the necessary information within 21 days of receiving the request, they could receive an infringement notice and be fined as high as $750.
Furthermore, there’s also a penalty of up to $900 for landlords or property managers who offer a false or inaccurate Healthy Homes Statement of Compliance or information. The person who is liable for this fine is the person who is identified on the tenancy agreement as being the person who is letting the property, so it could be the name of the landlord or the company that manages the property.
The information contained in the Compliance Statement requirements to be up-to-date before the tenancy agreement can be executed, and it should be kept updated through the tenancy period as necessary work related to it’s finished.
It is also crucial to keep in mind that landlords who manage multiple rental properties may receive additional fines for non-compliance. The highest penalties are handed down for serious breaches, and landlords with at least six rental properties could be penalised up to $50,000 and as high as $100,000 in the case of hearing claims.
