Fines for Failing to Comply

As of 1st July 2021, when a new, renewed or varied tenancy is signed on a Meeanee rental property, all Healthy Homes compliance items must be completed inside of 90 days.

Since the 1st July of 2021, when a brand new or renewed contract is signed on the Meeanee rental property, all Healthy Homes compliance work must be done by the end of 90 days.

Failure to comply with any of the Healthy Homes Standards within the deadlines can result in a fine of up to $7200. Additionally, if a currently-in place Healthy Homes Statement of Compliance isn’t included within a new, renewed or revised tenancy agreement, it could result in an additional penalty or infringement fee.

Anyone can request details about the Healthy Homes Standard and how they relate to the home they are living in. If the property manager does not provide the required information within 21 days of being informed of the request, they could receive an infringement letter and be fined as high as $750.

In addition, there’s an additional fine of as much as $900 for property owners or property managers providing a false or misleading Healthy Homes Compliance Statement or any other information. The person who is responsible for this fine is the person who is named on the lease agreement as the one who is leasing the property out which could be the landlord’s name or the company that manages the property.

All information in the Compliance Statement needs to be current when the tenancy agreement is completed, and is updated during the entire tenancy, as necessary work related to it’s finished.

It’s crucial to be aware that landlords who have multiple rental properties may receive more severe penalties for not complying. The most severe penalties are given for severe breaches. Landlords with six or more properties can be fined as high as $50,000, and as much as $100,000 in hearing claims.

Meeanee Healthy Homes Compliance Timeframes

Tenancies commenced from 1 July 2019 to the 30th June in 2021

  • Insulation of the underfloor and ceiling is mandatory throughout Meeanee and New Zealand rental houses where it is reasonably practicable to install.
  • A Healthy Homes Declaration of Intent An Insulation Statement as well as an Insurance Statement should be included in any new, renewed or amended tenancy agreement.
  • Property managers and landlords must keep records of their the conformance to all Healthy Homes Standard that apply or will be applicable during the tenure of the rental property.

Beginning 1 July 2021

  • Private landlords and property managers have to ensure that their rental properties are in compliance according to Healthy Homes Standards within 90 days of a new, renewed , or altered tenant.
  • All boarder homes (except Kainga Ora and Community Housing Providers with registered Boarding house tenancies) are required to comply with Healthy Homes Standards regardless of the time the tenancy began.

From July 1st 2023

  • All households which are rented by Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must be in compliance with the Healthy Homes Standards regardless of the date the tenancy was started.

From 1 July 2024

  • All rentals homes must comply with the Healthy Homes Standards regardless of when the tenancy first began.

Meeanee rental properties should have a permanent source of heat which can warm the principal or the biggest living room to at least 18degC, even during the coldest days of the year.
