Fines for Failing to Comply

From the 1st of July in 2021, if a new or renewed contract is signed on a Maraenui rental property, all Healthy Homes compliance tasks need to be finished within 90 days.

As of 1st July 2021, once a new or renewed Tenancy is signed for the Maraenui rental property, all Healthy Homes compliance work must be taken care of within 90 days.

Inability to adhere to any of the Healthy Homes Standards inside of the anticipated timeframe could result in penalties of up to $7200. Furthermore, if a currently-in place Healthy Homes Statement of Compliance is not included within a new, renewed or revised tenancy agreement, it could result in an additional fine or infringement fee.

Any tenant can ask for information regarding the Healthy Homes Standard and how they relate to the building they reside in. If the property manager is unable to provide the required information within 21 days of being informed of the request, they could receive an infringement notification and be fined up to $750.

Furthermore, there’s also a penalty as much as $900 for landlords and property managers providing a false or misleading Healthy Homes Compliance Statement or other information. The person liable for this fine is the one who is named on the tenancy agreement as the person who is letting the property out and it could be the landlord’s name or the property management company.

All the information on the Statement of Compliance requirements to be accurate before the tenancy agreement can be signed, and ideally it is updated throughout the duration of the tenancy when any relevant work gets completed.

It’s important to note that a landlord who have multiple rental properties may face even higher fines for non-compliance. The harshest penalties are handed down only for serious violations. Those who have six or more properties can be penalised up to $50,000, or as high as $100,000 in hearings.

Maraenui Healthy Homes Compliance Timeframes

Tenancies commenced between 1 July 2019 to 30 June 2021

  • Underfloor and ceiling insulation is compulsory throughout Maraenui and New Zealand rental homes where it’s reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement as well as an Insulation Statement, and an Insurance Statement should be included in any renewal, new or amended tenancy agreement.
  • Landlords and property managers must keep records to demonstrate conformance with all Healthy Homes Standard that apply or will be in force throughout the tenancy period of your rental home.

Starting 1 July 2021

  • Property managers and private landlords have to make sure their rental properties conform in accordance with Healthy Homes Standard within 90 days of any newly renewed, extended or changed tenancy.
  • All the boarding houses (except Kainga Ora and registered Community Housing Provider boarder home tenancies) must comply with the Healthy Homes Standards regardless of when the tenancy began.

From 1 July 2023

  • All houses let by Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must meet the Healthy Homes Standards regardless of the date when the tenancy started.

From 1 July 2024

  • All rentals homes must be in compliance with the Healthy Homes Standard regardless of when the tenancy first began.

For example, if an open fireplace isn’t used it can create draughts. This should be shut from. Property managers and landlords are responsible for ensuring such draughts are eliminated in the maximum extent imaginable.

There is no need to cover up holes or gaps which are part of the building. For example, tiny gaps around doors and windows may be required to allow for movement within the building when the home heats and cools, so that they can still be closed and opened instead of than securing. A good heating system is crucial for healthy homes

Heating Maraenui

Rental properties in Maraenui should have a permanent heating source which can warm the largest or main living space to a minimum of 18degC even on the most coldest days of the year. This is the recommended minimum indoor temperature recommended by the World Health Organisation for people’s physical well-being and mental wellbeing.

The source of heat needs for it to be permanent (i.e., not portable) and at least 1.5 horsepower in capacity, and meet the minimum heating capacity needed in the living area. A Heating Assessment Tool could be used to determine if the fixed heater(s) are sufficient or whether you will require to top up with an additional heater. Fires that are open and unflued heaters such as portable LPG bottle heaters are not considered to be safe heating options in the Healthy Homes Standard.

If the heating that you provide is an electric heater or heat source, then it must be equipped with a thermostat. This will help make the heating more uniform and efficient. For the majority of houses, bigger fixed heating equipment like heat pumps, wood burners, pellet burners or flued gas heaters are needed. In some instances, like small apartments, a smaller fixed electric heater may be sufficient.

If your main living space already has a central heating source like the heat pump, it may need an upgrade to meet the standards. Certain kinds of heaters aren’t able to be used to comply with the quality because they’re inefficient, unaffordable to operate and/or unsafe to run.

Ventilation Maraenui

Each living space within a rental property must contain at minimum one open door or window to provide natural ventilation. Additionally, areas with high moisture areas such as kitchens and bathrooms need to have an externally vented extractor fan that can eliminate moisture.

Insulation for underfloor and ceilings has been compulsory in all rental houses from 1 July 2019. All landlords and property managers have to ensure that the insulation is up to current standard. In some instances, current ceiling insulation, or the insulation of the sub floor space might require to be topped up or replaced.
