Fines for Failing to Comply

Beginning on July 1st, 2021, once a new, renewed or varied tenancy is signed on a Longlands rental property, all Healthy Homes compliance items need to be done by the end of 90 days.

Since the 1st July of 2021, if a new, renewed or varied Tenancy is signed for a Longlands rental property, all Healthy Homes compliance work must be finished within 90 days.

Failure to adhere to each of Healthy Homes Standards within the period of time expected can lead to a fine of up to $7200. Additionally, if the most existing Healthy Homes Statement of Compliance isn’t incorporated in the renewal, new or revised tenancy contract, it could result in an additional fine or infringement fee.

Every tenant is entitled to request details about the Healthy Homes Standard and how they relate to the building they reside in. If the landlord or property manager is unable to provide the required information within 21 days from being informed of the request, they can be issued an infringement notice and be fined upto $750.

In addition, there is an additional fine of approximately $900 for landlords and property managers that provide false or false Healthy Homes Statement of Compliance or any other information. The person responsible for this fine is the person who is listed on the tenancy contract as the person leasing the property out, so it could be the landlord’s name or the property management company.

All information in the Statement of Compliance needs to be correct at the time that the tenancy agreement is completed, and must be updated throughout the duration of the tenancy when any relevant work gets completed.

It is also important to be aware that a landlord who manage multiple rental properties could face greater penalties for non-compliance. The highest penalties are given for serious violations. Those who have six or more properties can be fined up to $50,000, and as much as $100,000 in the case of hearing claims.

Longlands Healthy Homes Compliance Timeframes

Tenancies that were signed between 1 July 2019 and the 30th June in 2021

  • The insulation of the ceiling and underfloor is compulsory throughout Longlands and New Zealand rental houses where it is reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement An Insulation Statement as well as an Insurance Statement must be included in any renewal, new or amended tenancy agreement.
  • Landlords and property managers must keep records that demonstrate compliance with any Healthy Homes Standards that apply or will be applicable to the rental property.

From 1 July 2021

  • Private landlords and property managers are required to ensure their rental properties conform in accordance with Healthy Homes Standard within 90 days of a new, renewed or varied lease.
  • All boarding homes (except Kainga Ora and Community Housing Providers with registered for boarding home tenancies) must meet the Healthy Homes Standard regardless of when the tenancy began.

Starting 1 July 2023

  • All houses which are rented from Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must meet the Healthy Homes Standards regardless of when the tenancy first began.

Beginning 1 July 2024

  • All rental houses must be in compliance with the Healthy Homes Standards regardless of when the tenancy first began.
Unreasonable Gaps & Holes

Draught Stopping Longlands

Draughts are a major cause of lower temperatures in houses. A humid home is more expensive to heat, meaning wasting money and energy.

If a draught can be noticed from gaps that are not adequate or holes, it needs to be sealed.

What are unreasonable gaps and holes?

If you can feel external air entering or the sound of a clear draught emanating from a hole or gap, then it’s probably a gap or crack that requirements sealing in some way. Large gaps and cracks should be stopped permanently. Any gaps greater than 3mm that allow air to enter or exit into the house require to be sealed. In the case of an open fireplace isn’t being used, it may cause draughts and should be blocked off. Property managers and landlords are responsible for ensuring such draughts are eliminated as far as possible.

There is no require to block up intentional gaps or holes that are part of the construction. For instance, small gaps around windows and doors could be necessary to allow for the movement of the building as the household is heated and cools in order to let them be shut and opened, rather than being stuck. Heating Longlands

Longlands rental properties should have a permanent source of heating that is able to heat the principal or the biggest living area to at minimum 18degC, even during the most coldest days of the year. This is the minimum temperature indoors that is recommended by the World Health Organisation for people’s physical well-being and mental well-being.

The source of heating requirements that it be permanently fixed (i.e. not portable), at minimum 1.5 horsepower in capacity, and must meet the minimum requirement for heat capacity in the living area. A Heating Assessment Tool could be used to determine if the fixed heater(s) are adequate or if you’ll require to "top up" with an additional heater. Open fires as well as unflued combustion heaters, such as portable LPG bottle heaters are not considered to be safe heating options under those following the Healthy Homes Standard.

If the heating system you offer is an electric heater (or heat pump), it should have an thermostat. This will make the heating more uniform and effective. Ventilation Longlands

Insulation Longlands

Underfloor and ceiling insulation is required to all rental houses from 1 July 2019. Property managers and landlords must make sure that the insulation meets standards that are in line with the latest standard. In some instances, existing ceiling insulation or insulation in the subfloor space may need to be filled with or replaced.

A properly insulated home can reduce condensation and lower the chance of mould and dampness, and also makes an easier task for the house to retain heat.
