Fines for Failing to Comply

Beginning on July 1st, 2021, once a new or renewed tenancy is signed on a Karamu rental property, all Healthy Homes compliance tasks need to be completed inside of 90 days.

From the 1st of July in 2021, if a new or renewed tenancy is signed on a Karamu rental property, all Healthy Homes compliance work must be finished within 90 days.

Failure to comply with each of Healthy Homes Standards inside of the period of time expected can lead to a fine of up to $7200. Furthermore, if a present Healthy Homes Statement of Compliance isn’t included in the renewal, new or amended tenancy agreement there may be an additional fine or infringement fee.

Every tenant is entitled to request information about the Healthy Homes Standard and how they relate to the home they live in. If the property manager is unable to provide the necessary information within 21 days of receiving the request, they can be issued an infringement notice and be fined as high as $750.

Furthermore, there’s an additional fine of approximately $900 for landlords and property managers who offer a false or false Healthy Homes Compliance Statement or other information. The person liable for this fine is the person who is named on the lease agreement as the one who is letting the property out and it could be the name of the landlord as well as the company that manages the property.

The information contained in the Compliance Statement needs to be current when the tenancy contract is executed, and it should be kept updated throughout the tenancy as any necessary work related to it’s finished.

It’s crucial to remember that a landlord who manage multiple rental properties could face greater penalties for non-compliance. The most severe penalties are reserved only for serious violations, and landlords who own more than six properties could be fined as high as $50,000, or as high as $100,000 in hearings.

Karamu Healthy Homes Compliance Timeframes

Tenancies commenced between 1 July 2019 and 30 , June 20,21

  • Underfloor and ceiling insulation is compulsory for all Karamu and New Zealand rental homes where it is reasonably practicable to put in.
  • A Healthy Homes Intent to Comply Statement, an Insulation Statement and an Insurance Statement must be included with any renewal, new or amended tenancy agreement.
  • Property managers and landlords are required to keep records to demonstrate the compliance with each Healthy Homes Standards that apply or will apply during the tenancy of your rental home.

From 1 July 2021

  • Private landlords and property managers have to make sure their rental properties comply according to Healthy Homes Standards within 90 days of any new, renewed , or altered Tenancy.
  • All boarding households (except Kainga Ora and Community Housing Providers with registered for boarding house tenancies) are required to comply with Healthy Homes Standards regardless of the date when the tenancy started.

Beginning 1 July 2023

  • All homes rented to Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered are required to comply with the Healthy Homes Standards regardless of when the tenancy first began.

Beginning 1 July 2024

  • All rentals houses must be in compliance with the Healthy Homes Standard regardless of the date when the tenancy started.
