Fines for Failing to Comply

From the 1st of July in 2021, if a new, renewed or varied tenancy is signed on an Iona rental property, all Healthy Homes compliance tasks need to be taken care of within 90 days.

Beginning on July 1st, 2021, when a brand new or renewed Tenancy is signed for an Iona rental property, all Healthy Homes compliance work must be taken care of within 90 days.

Failure to comply with all of the Healthy Homes Standards inside of the deadlines can result in penalties of up to $7200. In addition, if the currently-in place Healthy Homes Statement of Compliance is not incorporated within a new, renewed or amended tenancy agreement there may be an additional penalty or infringement fee.

The person who is responsible to pay this fine is the one who is named on the lease agreement as the person who is who is letting the property, so it could be the name of the landlord or the property management company.

All information in the Compliance Statement requirements to be up-to-date when the tenancy agreement is completed, and should be maintained through the tenancy period as associated work has been completed.

It’s also crucial to remember that a landlord with several rental properties can face additional fines for non-compliance. The harshest penalties are reserved only for serious violations, and landlords who own more than six properties could be fined as high as $50,000, or as high as $100,000 in the case of hearing claims.

When do I require to be in compliance with requirements of the Healthy Homes Standards?

Iona Healthy Homes Compliance Timeframes

Tenancies signed beginning on 1 July 2019 and 30 , June 20,21

  • Insulation of the underfloor and ceiling is a requirement for all Iona and New Zealand rental houses where it is reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement as well as an Insulation Statement, and an Insurance Statement must be included with any new, renewed or altered tenancy contract.
  • Property managers and landlords must keep records that prove the conformance to any Healthy Homes Standards that apply or will be in force to the rental property.

From July 1st 2021

  • Private landlords and property managers should make sure their rental properties comply with the Healthy Homes Standard within 90 days of a newly renewed, extended or changed Tenancy.
  • All boarding households (except Kainga Ora and Community Housing Providers with registered boarding household tenancies) must comply with the Healthy Homes Standards regardless of the date the tenancy was started.

From July 1st 2023

  • All homes which are rented to Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must comply with the Healthy Homes Standards regardless of when the tenancy began.

Starting 1 July 2024

  • All rentals houses must comply with the Healthy Homes Standard regardless of the time of the first day of tenancy.
Unreasonable Gaps & Holes

Draughts increase the likelihood of lower temperatures in homes. A humid house will cost more to heat, meaning wasting energy and resulting in higher bills.

What are unreasonable gaps or holes?

If you can feel external air entering or the sound of a clear draught emanating from a hole or gap that is, it is likely to be a gap or hole which needs sealing in somehow. Large cracks and gaps should be stopped permanently. Any gaps greater than 3mm that let air in or out within your house require seals. For example, if the open fireplace isn’t being used, it can create draughts. This must be sealed off. Landlords and property managers are accountable for ensuring that such draughts are squelched as far as possible.

There is no need to block holes or gaps which are part of the construction. For instance, small gaps around windows and doors might be necessary to allow for movement of the building as the home heats and cools, in order to let them be opened and closed rather instead of being stuck. The proper heating equipment is crucial for healthy homes

Heating Iona

Iona rental properties must have a fixed heating source that can heat the largest or main living space to a minimum of 18degC, even on the winter coldest days. This is the minimum temperature indoors recommended by the World Health Organisation for people’s physical well-being as well as their mental health.

The heating source requirements to remain fixed (i.e. not portable) with at least 1.5 Kilowatts in heating capacity, and must meet the minimum requirement for heat capacity for the main living space. For most homes, larger fixed heating equipment like heat pumps, wood burners pellet burners, flued gas heaters are necessary. In certain situations, like small apartment buildings the smaller fixed electric heater could be enough.

If your main living space already has a fixed heating source, such as heat pumps, it could require an upgrade to ensure it meets the requirements. Certain kinds of heaters cannot be utilised to meet the quality because they’re not effective, cost prohibitive to operate and/or unsafe to run.

Ventilation Iona

The insulation of the ceiling and underfloor has been compulsory on all rental houses since 1 July 2019. All landlords and property managers should ensure that the insulation is up to this new standard. In some instances, existing ceiling insulation or insulation in the subfloor space might require to be replaced or replaced.
