Fines for Failing to Comply

Beginning on July 1st, 2021, when a brand new, renewed or varied tenancy is signed on a Hospital Hill rental property, all Healthy Homes compliance work must be taken care of within 90 days.

From the 1st of July in 2021, once a new or renewed lease is entered into on a Hospital Hill rental property, all Healthy Homes compliance work must be finished inside of 90 days.

Failure to comply with all of the Healthy Homes Standards by the end of the period of time expected can lead to a fine of up to $7200. Additionally, if a present Healthy Homes Statement of Compliance isn’t incorporated in an updated, renewed, or revised tenancy agreement it could result in an additional penalty or infringement fee.

Any tenant may request details regarding the Healthy Homes Standard and how they are related to the house they reside in. If the landlord or the property manager doesn’t provide the necessary information within 21 days from being informed of the request, they could receive an infringement notification and could be fined up to $750.

In addition, there is also a penalty of approximately $900 for property owners or property managers providing a false or inaccurate Healthy Homes Compliance Statement or any other information. The person who is liable for this fine is whoever is named on the tenancy contract as the person letting the property out, so it could be the landlord’s name or the company that manages the property.

The information contained in the Statement of Compliance needs to be accurate at the time that the tenancy agreement is executed, and it should be kept updated throughout the duration of the tenancy when any relevant work gets completed.

It is also important to keep in mind that landlords who manage multiple rental properties may face greater penalties for non-compliance. The most severe penalties are given for serious violations. Those who have more than six properties could be fined as high as $50,000, and even as high as $100,000 in hearings.

Hospital Hill Healthy Homes Compliance Timeframes

Tenancies commenced beginning on 1 July 2019 to 30 June 2021

  • Insulation of the underfloor and ceiling is compulsory in all Hospital Hill and New Zealand rental homes where it is reasonably practicable to install.
  • A Healthy Homes Declaration of Intent along with an Insulation Declaration and an Insurance Statement should be included in any renewed, new or amended tenancy agreement.
  • Property managers and landlords have to keep records that prove compliance with the Healthy Homes Standard that apply or will be applicable to an apartment rental.

Starting 1 July 2021

  • Property managers and private landlords must ensure their rental properties conform with the Healthy Homes Standard within 90 days of a newly renewed, extended or changed tenancy.
  • All boarder houses (except Kainga Ora and registered Community Housing Provider boarder house tenancies) are required to comply with Healthy Homes Standards regardless of the date the tenancy was started.

From July 1st 2023

  • All homes let to Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must be in compliance with the Healthy Homes Standards regardless of when the tenancy began.

From 1 July 2024

  • All rentals houses are required to comply with Healthy Homes Standards regardless of the date when the tenancy started.

Heating Hospital Hill

Rental properties in Hospital Hill need to have a stable heating source which can warm the living room to at least 18degC, even on the coldest winter days. This is the minimum indoor temperature recommended by the World Health Organisation for people’s physical well-being as well as their mental health.

The source of heating requirements for it to be permanent (i.e. not portable), at minimum 1.5 Kilowatts in heating capacity, and it must have the minimum required heating capacity for the main living room. However, in certain instances like small apartments small apartments, a smaller electric fixed heater may be sufficient.

If the main living room is already equipped with a fixed heating source, like the heat pump, it could require some additional energy to be able to meet the standards. Some types of heaters can’t be used to achieve the quality as they are either not efficient, cost prohibitive to operate and/or unsafe to run.

Ventilation Hospital Hill

Insulation Hospital Hill

Underfloor and ceiling insulation is a requirement to all rental homes from 1 July 2019. Property managers and landlords are required to ensure that the insulation meets the new standard. In some cases, an existing insulation on the ceiling or in the subfloor space might need to be filled with or replaced.
