Fines for Failing to Comply

As of 1st July 2021, when a brand new or renewed tenancy is signed on a Havelock North Central rental property, all Healthy Homes compliance items have to be completed within 90 days.

Since the 1st July of 2021, if a new, renewed or varied tenancy is signed on the Havelock North Central rental property, all Healthy Homes compliance work must be taken care of inside of 90 days.

Inability to adhere to each of Healthy Homes Standards within the anticipated timeframe could result in penalties of up to $7200. Additionally, if the most current Healthy Homes Statement of Compliance isn’t incorporated in the new, renewed or revised tenancy contract, there may be an additional penalty or infringement fee.

The person who is liable for this fine is the one who is listed on the tenancy agreement as being the person leasing the property out which could be the name of the landlord or the company that manages the property.

All the information on the Compliance Statement needs to be up-to-date when the tenancy agreement is signed, and ideally it should be kept updated during the entire tenancy, as necessary work related to it’s finished.

It’s important to remember that landlords who have multiple rental properties may receive even higher fines for non-compliance. The harshest penalties are given for the most serious breaches. Landlords with at least six rental properties could be penalised up to $50,000, or as high as $100,000 in hearing claims.

When will I need to meet The Healthy Homes Standards?

Havelock North Central Healthy Homes Compliance Timeframes

Tenancies signed from 1 July 2019 and the 30th June in 2021

  • Ceiling and underfloor insulation is required throughout Havelock North Central and New Zealand rental houses where it’s reasonably practicable to install.
  • A Healthy Homes Declaration of Intent, an Insulation Statement and an Insurance Statement should be included with any renewed, new or varied tenancy agreement.
  • Property managers and landlords have to keep records of their the conformance to all Healthy Homes Standards that apply or will apply during the tenancy of the rental property.

Beginning 1 July 2021

  • Private landlords and property managers should ensure that their rental properties are in compliance in accordance with Healthy Homes Standards within 90 days of a new, renewed , or altered tenant.
  • All boarding homes (except Kainga Ora and Community Housing Providers with registered for boarding home tenancies) must comply with the Healthy Homes Standards regardless of the date the tenancy was started.

From 1 July 2023

  • All houses which are rented by Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers are required to comply with the Healthy Homes Standards regardless of when the tenancy first began.

Starting 1 July 2024

  • All rental homes must comply with the Healthy Homes Standards regardless of when the tenancy first began.

Heating Havelock North Central

Rental properties in Havelock North Central need to have a stable source of heat that can warm the living space to a minimum of 18degC, even on the most coldest days of the year. This is the minimum temperature indoors suggested by the World Health Organisation for people’s physical well-being and mental wellbeing.

However, in certain instances like apartments with small spaces an electric, fixed heater might be enough.

If your main living space is already equipped with a fixed heating source, such as the heat pump, it could require an update to ensure it meets the requirements. Certain kinds of heaters cannot be used to comply with the quality as they are either costly, not cost-effective to run, or are unsafe to operate.
