Fines for Failing to Comply

From the 1st of July in 2021, once a new, renewed or varied tenancy is signed on a Haumoana rental property, all Healthy Homes compliance work have to be done within 90 days.

As of 1st July 2021, if a new or renewed contract is signed on a Haumoana rental property, all Healthy Homes compliance work must be completed within 90 days.

Failure to meet one of the Healthy Homes Standards by the end of the anticipated timeframe could result in an amount of $7200. Additionally, if the most present Healthy Homes Statement of Compliance is not included in an updated, renewed, or revised tenancy agreement it could result in an additional fine or infringement fee.

Haumoana Healthy Homes Compliance Timeframes

Tenancies that were signed from 1 July 2019 and 30 , June 20,21

  • Insulation of the underfloor and ceiling is a requirement to all Haumoana and New Zealand rental homes where it’s reasonably practicable to install.
  • A Healthy Homes Declaration of Intent, an Insulation Statement and an Insurance Statement should be included with any renewed, new or altered tenancy contract.
  • Landlords and property managers must keep records to demonstrate conformance with all Healthy Homes Standards that apply or will be applicable during the tenancy of your rental home.

Beginning 1 July 2021

  • Property managers and private landlords should ensure their rental properties comply in accordance with Healthy Homes Standards within 90 days of any new, renewed , or altered lease.
  • All the boarding households (except Kainga Ora and Community Housing Providers with registered boarder house tenancies) are required to comply with Healthy Homes Standards regardless of the time the tenancy began.

From 1 July 2023

  • All homes rented to Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must comply with the Healthy Homes Standards regardless of the date when the tenancy started.

From July 1st 2024

  • All rental houses must be in compliance with the Healthy Homes Standard regardless of the time of the first day of tenancy.

Heating Haumoana

Haumoana rental properties require a reliable source of heating that can heat the living space to at least 18degC, even on the most coldest days of the year. This is the minimum temperature indoors that is recommended by the World Health Organisation for people’s physical health and mental well-being.

Fires that are open and unflued heaters like small portable LPG bottle heaters aren’t considered to be safe heating options in the Healthy Homes Standard.

If the heating that you provide is an electric heater (or heat pump), it needs to be equipped with an thermostat. This will help make your heating more consistent and efficient. For the majority of homes, bigger heaters that are fixed, such as wood burners, heat pumps, pellet burners or flued gas heaters are needed. In some instances, like small apartments the smaller fixed electric heater may be sufficient.
