Fines for Failing to Comply

The person liable for this fine is the one who is named on the tenancy agreement as the one who is letting the property out and it could be the name of the landlord or the company that manages the property.

The information contained in the Statement of Compliance needs to be current at the time that the tenancy agreement is completed, and must be updated during the entire tenancy, as relevant work gets completed.

It’s also crucial to note that landlords with multiple rental properties may receive more severe penalties for not complying. The highest penalties are handed down for serious violations, and landlords who own six or more properties can receive fines of up to $50,000, and as much as $100,000 in the case of hearing claims.

Glengarry Healthy Homes Compliance Timeframes

Tenancies commenced between 1 July 2019 and the 30th June in 2021

  • Insulation of the underfloor and ceiling is compulsory in all Glengarry and New Zealand rental homes where it’s reasonably practicable to install.
  • A Healthy Homes Statement of Intent to Comply An Insulation Statement as well as an Insurance Statement should be included in any renewal, new or altered tenancy contract.
  • Landlords and property managers must keep records that demonstrate compliance with the Healthy Homes Standard that apply or will be applicable during the tenure of the rental property.

From 1 July 2021

  • Property managers and private landlords have to make sure their rental properties conform with the Healthy Homes Standards within 90 days of any new, renewed , or altered Tenancy.
  • All boarding houses (except Kainga Ora and Community Housing Providers with registered for boarding house tenancies) must comply with the Healthy Homes Standards regardless of the date the tenancy was started.

Starting 1 July 2023

  • All homes that are rented out through Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must comply with the Healthy Homes Standards regardless of when the tenancy began.

From July 1st 2024

  • All rentals houses are required to comply with Healthy Homes Standard regardless of the date when the tenancy started.
Unreasonable Gaps & Holes

Draught Stopping Glengarry

Draughts are a major cause of less temperature in houses. A humid home is more expensive to heat, which means wasting money and energy.

What are unreasonable gaps or holes?

If you are able to feel external air entering or the sound of a clear draught emanating from a hole or gap that is, it is likely to be a gap or crack that needs sealing in somehow. Cracks or gaps with large gaps must be stopped permanently. Any gaps greater than 3mm that allow air in or out of the home require sealing. In the case of an open fireplace is not in use, it can create draughts. This must be sealed off. Property managers and landlords are accountable for ensuring that such draughts are squelched whenever possible.

You don’t require to block up intentional holes or gaps that are part of the building. For instance, small gaps around doors and windows could be required to allow for movement of the building when the house warms and cools in order to let them be opened and closed rather instead of being stuck. Adequate heaters are important to ensure well-being homes

Heating Glengarry

Rental properties in Glengarry must have a fixed source of heating that can heat the main or largest living space to at least 18 degrees Celsius, even on the coldest winter days. This is the recommended minimum indoor temperature that is recommended by the World Health Organisation for people’s physical health and mental outlook.

The source of heating needs to be fixed (i.e. not portable) with at least 1.5 horsepower in capacity, and meet the minimum requirement for heat capacity to heat the living space in general. A Heating Assessment Tool could be used to determine whether the current permanent heater(s) are sufficient or if you’ll need to ‘top up’ with an additional heater. Open fires and unflued combustion heaters like mobile LPG bottle heaters aren’t considered to be safe heating options under the Healthy Homes Standard.

If the heating that you provide is an electric heater or heat pump it needs to be equipped with an thermostat. This will make the heating more reliable and effective. In most houses, larger fixed heating equipment like wood burners, heat pumps, pellet burners or flued gas heaters are needed. However, in certain instances such as small apartments, a smaller fixed electric heater might be enough.

All landlords and property managers are required to make sure that the insulation is in line with this new standard.
