Fines for Failing to Comply

From the 1st of July in 2021, once a new, renewed or varied tenancy is signed for a Flaxmere rental property, all Healthy Homes compliance items have to be taken care of inside of 90 days.

Flaxmere Healthy Homes Compliance Timeframes

Tenancies signed between 1 July 2019 and 30 June 2021

  • Underfloor and ceiling insulation is a requirement for all Flaxmere and New Zealand rental homes where it is reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement, an Insulation Statement and an Insurance Statement should be included in any renewed, new or amended tenancy agreement.
  • Property managers and landlords must keep records to demonstrate compliance with any Healthy Homes Standard that apply or will be in force during the tenure of the rental property.

From July 1st 2021

  • Private landlords and property managers are required to make sure their rental properties conform according to Healthy Homes Standard within 90 days of any new, renewed , or altered tenancy.
  • All boarding households (except Kainga Ora and registered Community Housing Provider Boarding home tenancies) are required to comply with Healthy Homes Standard regardless of the date the tenancy was started.

From 1 July 2023

  • All households that are rented out by Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must be in compliance with the Healthy Homes Standards regardless of the date when the tenancy started.

From 1 July 2024

  • All rental homes have to meet the Healthy Homes Standards regardless of the date when the tenancy started.
