Fines for Failing to Comply

From the 1st of July in 2021, once a new or renewed tenancy is signed on a Camberley rental property, all Healthy Homes compliance items need to be finished by the end of 90 days.

As of 1st July 2021, once a new, renewed or varied lease is entered into on the Camberley rental property, all Healthy Homes compliance work must be taken care of within 90 days.

Failure to meet one of the Healthy Homes Standards within the period of time expected can lead to the possibility of a fine up to $7200. Additionally, if a present Healthy Homes Statement of Compliance is not included in the new, renewed or revised tenancy contract, it could result in an additional penalty or infringement fee.

It’s crucial to remember that landlords who have multiple rental properties may face more severe penalties for not complying. The highest penalties are given for the most serious breaches. Landlords with at least six rental properties could be fined up to $50,000 and as high as $100,000 in the case of hearing claims.

Camberley Healthy Homes Compliance Timeframes

Tenancies commenced from 1 July 2019 and the 30th June in 2021

  • The insulation of the ceiling and underfloor is a requirement throughout Camberley and New Zealand rental homes where it’s reasonably practicable to put in.
  • A Healthy Homes Declaration of Intent, an Insulation Statement and an Insurance Statement must be included with any renewal, new or modified tenancy agreement.
  • Property managers and landlords are required to keep records of their compliance with the Healthy Homes Standard that apply or will apply during the tenancy of the rental property.

From July 1st 2021

  • Private landlords and property managers have to make sure that their rental properties are in compliance in accordance with Healthy Homes Standard within 90 days of any new, renewed , or altered Tenancy.
  • All boarder households (except Kainga Ora and Community Housing Providers with registered boarding household tenancies) must comply with the Healthy Homes Standards regardless of the time the tenancy began.

Beginning 1 July 2023

  • All households which are rented to Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must comply with the Healthy Homes Standards regardless of the date when the tenancy started.

From 1 July 2024

  • All rental houses are required to comply with Healthy Homes Standard regardless of the time of the first day of tenancy.

Camberley rental properties must have a fixed heating source that is able to heat the living space to a minimum of 18degC, even during the most coldest days of the year. If the main living room already has a central heating source such as the heat pump, it could need a top up to meet the standards. Certain types of heaters cannot be used to meet the quality because they’re inefficient, unaffordable to operate and/or unsafe to run.
