Fines for Failing to Comply

From the 1st of July in 2021, when a brand new or renewed tenancy is signed on a Bluff Hill rental property, all Healthy Homes compliance tasks have to be taken care of inside of 90 days.

The information contained in the Statement of Compliance needs to be accurate at the time that the tenancy agreement is completed, and should be kept updated through the tenancy period as associated work has been completed.

It is also important to keep in mind that a landlord with multiple rental properties could face more severe penalties for not complying. The highest penalties are handed down for serious breaches. Landlords with at least six rental properties could be fined as high as $50,000, and even as high as $100,000 for hearing claims.

Bluff Hill Healthy Homes Compliance Timeframes

Tenancies established from 1 July 2019 to 30 , June 20,21

  • Underfloor and ceiling insulation is a requirement to all Bluff Hill and New Zealand rental homes where it is reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement, an Insulation Statement and an Insurance Statement should be included with any new, renewed or amended tenancy agreement.
  • Property managers and landlords must keep records of their the compliance with all Healthy Homes Standard that apply or will apply to the rental property.

From 1 July 2021

  • Property managers and private landlords should make sure that their rental properties are in compliance with the Healthy Homes Standard within 90 days of a renewal, new or a change in tenant.
  • All boarding houses (except Kainga Ora and registered Community Housing Provider for boarding home tenancies) are required to comply with Healthy Homes Standard regardless of the date the tenancy was started.

From July 1st 2023

  • All houses let to Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must be in compliance with the Healthy Homes Standards regardless of the date when the tenancy started.

From July 1st 2024

  • All rental houses must be in compliance with the Healthy Homes Standard regardless of when the tenancy began.
Unreasonable Gaps & Holes

Draught Stopping Bluff Hill

Heating Bluff Hill

Bluff Hill rental properties need to have a stable source of heat that is able to heat the principal or the biggest living area to at minimum 18degC, even during the winter coldest days. If the heating that you provide is an electric heater (or heat pump), then it must have an thermostat. This will make the heating more consistent and effective. For most houses, larger heaters that are fixed, such as wood burners, heat pumps, pellet burners or flued gas heaters are necessary. In some instances, like apartments with small spaces small apartments, a smaller electric fixed heater may suffice.
