Fines for Failing to Comply
Beginning on July 1st, 2021, if a new, renewed or varied tenancy is signed for an Anderson Park rental property, all Healthy Homes compliance work must be completed by the end of 90 days.
Since the 1st July of 2021, when a brand new, renewed or varied Tenancy is signed for the Anderson Park rental property, all Healthy Homes compliance work must be taken care of by the end of 90 days.
Failure to comply with each of Healthy Homes Standards within the deadlines can result in penalties of up to $7200. In addition, if the existing Healthy Homes Statement of Compliance is not included in the renewal, new or amended tenancy agreement there may be additional penalties or an infringement fee.
Any tenant may request information about the Healthy Homes Standard and how they are related to the house they live in. If the the property manager doesn’t supply the information requested within 21 days from being informed of the request, they will receive an infringement letter and be fined as high as $750.
In addition, there is an additional fine of as much as $900 for property owners or property managers who have provided a false or false Healthy Homes Statement of Compliance or other information. The person who is responsible to pay this fine is the one who is listed on the tenancy agreement as the person who is who is letting the property and it could be the landlord’s name or the company that manages the property.
All information in the Compliance Statement needs to be accurate when the tenancy agreement is completed, and must be updated throughout the tenancy as any associated work has been completed.
It’s also important to note that landlords who own multiple rental properties may receive even higher fines for non-compliance. The highest penalties are given for severe breaches. Landlords with at least six rental properties could be penalised up to $50,000, or as high as $100,000 in hearings.
